Rural Nanaimo firefighter wins wrongful dismissal case
NANAIMO — A longtime paid-on-call North Cedar Fire Department member’s dismissal was discrimination due to his mental disability, ruled the BC Human Rights Tribunal.
The recently published ruling outlined the case between Joseph Widdifield and North Cedar Improvement District (NCID), following the complainant’s July 2, 2021, termination while he was on a three-month leave.
While the NCID denied Widdifield’s Post-Traumatic Stress Disorder was a factor in the firing, the tribunal was not persuaded NCID fulfilled its duty to accommodate the complainant’s condition.
Widdifield had been a paid-on-call firefighter with the department for eight years, beginning in 2013.
