Screaming, damage and fire hazards leads to Mt. Benson St. apartment being designated a nuisance

NANAIMO — Local police have had enough trouble with a central Nanaimo apartment owner and his apartment is now considered a nuisance property.

City council voted Monday to designate unit 204 at 311 Mt. Benson St. a nuisance after three calls in September. While the number of calls isn’t particularly high, a staff report shows it’s just the number of calls since the owner returned to the property that month.

Community safety manager Dave LaBerge told Council the property was actually supposed to come to council much earlier in winter 2017 for similar concerns.

“These involved matters of yelling and screaming within the building, damaging property, there was a window in someone’s vehicle which was smashed, a surveillance camera was broken, screaming and conflict and yelling off the balcony as people passed on the street,” LaBerge explained.

Thirteen nuisance calls were made between May and November of 2017.

After the owner left in winter 2017, LaBerge said the same behaviour “promptly resumed” when the owner returned in September of this year.

In just a short time, a new and significant concern was raised.

“There’s no power to the apartment and neighbours saw him bringing firewood and combustible items into the apartment,” LaBerge said. With no fireplace installed or anywhere to burn the wood, he told council neighbours and Nanaimo Fire Rescue are very concerned about the property and any future damage.

Council voted unanimously to approve the nuisance designation, which means the property owner will now be billed for the time City staff and Nanaimo RCMP send dealing with the property.
