Man banned from owning animals for throwing chihuahua in Nanaimo
NANAIMO — A man is legally barred from owning or taking care of animals for two years after pleading guilty to abusing his dog.
A joint submission was accepted for Andrew Bernard Gardiner, 46, at Nanaimo Law Courts on Wednesday, Sept. 16, after Gardiner pleaded guilty to one count of causing or permitting an animal to be in distress, after two City of Nanaimo workers saw him dropping and throwing his chihuahua on Feb. 12, 2025.
During sentencing, provincial court judge Christina Proteau, quoting a judge from a previous case involving animal cruelty, said pets are sentient beings who are almost entirely dependent on their owners for the necessities of life.
“A person who takes custody of an animal has a positive obligation to ensure that animal’s needs are met. When an owner cannot meet those needs…the pet should not suffer because their owner is experiencing personal decline, their fates are not intrinsically linked.”
