City of Nanaimo sued over unpainted speed bump

NANAIMO — The City of Nanaimo is going to court for allegedly not keeping their speed bumps painted.

According to a notice of civil claim filed to the Supreme Court of B.C., Nanaimo resident Aubrey Robertson was biking down the hill on Townsite Rd. towards the Nanaimo Yacht Club on July 20, 2015.

Exactly two years ago, he allegedly rode over an unpainted speed bump near the club which crossed both the road and the bike lane, sending him over his handlebars and fracturing his elbow, injuring his rib and causing headaches.

The claim maintains there was some yellow paint on the bump near the curb, but none on the section crossing the road, making it practically invisible. As well, there were allegedly no signs saying there was an obstruction on the road to warn cyclists and drivers.
