Cedar man agrees to peace bond following online communication with underage girl

NANAIMO — A year long peace bond was applied to a man in relation to a series of alleged sexually explicit messages to a girl three years ago.

The order is not a criminal conviction, but rather an acknowledgment by Allan Thomas Wilson, 26, that the victim has reason to fear future similar offending.

A recent provincial court hearing in Nanaimo was told Wilson, then 23-years-old, reached out to a 14-year-old Facebook contact and allegedly sent her sexually explicit messages, as well as graphic images of himself.

Wilson was accused of offering the victim items such as money and drugs in exchange for sex and nude pictures of the victim during the February 2019 exchange.

The correspondence in question was reported to the victim’s mother and Wilson was arrested.

The Crown’s Jill Vivian told court three criminal code sex charges against Wilson were being dropped in exchange for the peace bond due to numerous issues challenging the Crown’s case.

Vivian noted the admissibility of a statement by Wilson to police was clouded by the cognitive abilities of the accused, triggering a medical report and confirmed Fetal Alcohol Syndrome Disorder diagnoses.

Court was also told Wilson has had at least three traumatic brain injuries, including when he was hit by vehicles as a helmetless cyclist on two occasions.

“And there was also in the course of that difficulties with verbal and written comprehension…That was a large concern,” Vivian said.

She also stated the victim wasn’t keen on going to court, wanted the upsetting incident behind her, and wanted certainty of an outcome.

“Ultimately what the the girl and her mother were looking to see was accountability and some protection of the public and of other girls.”

The defendant’s lawyer told court his Indigenous client has significant Gladue factors who spent most of his youth in foster care.

Wilson had no breaches while on bail for more than three years, court was told.

He elected not to address judge Justine Saunders.

His 12 month peace bond with numerous conditions includes a no contact order in person or electronically with minors, restricted internet usage and counselling.
