Bail denied to man accused of pointing handgun at teens

NANAIMO — Citing a risk to public safety and questions whether he’ll be properly monitored, a Nanaimo judge denied bail to a man accused of serious firearms offences.

The decision against Darian Scott Rogers, 27, from provincial court judge Sheila Archer was made during a Dec. 30 hearing in Nanaimo.

Rogers allegedly pointed a handgun at a vehicle with four teenagers inside as they drove by on Departure Bay Rd. near Wingrove St. on Sept. 4, 2021.

He was charged with three firearms offences, including possessing a weapon for a dangerous purpose.

Rogers is accused of pointing and tracking the vehicle with the prohibited gun, police said.

RCMP stated the teens got to a safe place and reported the incident to police.

Rogers was arrested nearby without incident and has been locked up ever since.

In the month leading up to the early-morning incident, Rogers was arrested and temporarily held in custody for assault. A few weeks later he was accused of breaching his release conditions a few days prior to the incident near Departure Bay Beach.

Judge Archer noted Rogers’ mother was listed as surety for his bail when an alleged assault by Rogers took place at her home.

The Judge stated her concerns about the ability of Rogers’ mother to properly hold her son accountable.

“I just find that she’s not an appropriate surety because I don’t find that she’s going to be able to prevent him from committing further offences while he’s on bail,” Judge Archer said.

A nine millimeter handgun and compatible bullet were found discarded separately near the scene off Departure Bay Rd.

Rogers previously served 20 months in jail for a 2016 assault in Nanaimo where he was issued a 10-year firearms ban.

Rogers is slated to be back in court on Jan 11.

None of the allegations stated against Rogers in this article have been proven in court.
