Woman sues City over alleged fall at Nanaimo Aquatic Centre

NANAIMO — A woman is suing the City of Nanaimo, claiming negligence by staff caused a fall which led to serious injuries.

A notice of civil claim filed in B.C. Supreme Court on Oct. 17 said Maida Valic suffered injuries to her ankle, knee and elbow when she stepped into a gap created by a retractable pool divider during a swim meet at the Nanaimo Aquatic Centre on Apr. 21.

Valic suffered pain, loss or impairment of ability to perform household tasks and is burdened by costs of future care, the claim alleged.

The Ladysmith woman is seeking compensation for pain and suffering, costs of transportation to medical treatments, medication and rehab, lost wages and replacement or repair of her damaged camera.

The claim alleged City employees “failed to ensure the pool divider was designed and constructed to be able to be retracted fully to the end of the pool to ensure the gap did not remain,” adding the City allegedly did not leave cones or signs to warn people about the risk of the gap.

None of the claims have been proven in court and the City has not filed a response.

The City declined comment as the matter is before the courts, while a lawyer for Valic did not respond to a request for details on the extent of her injuries or the amount of money being sought.
