City of Nanaimo settles lawsuit with former senior manager

NANAIMO — The City of Nanaimo won’t go to court over a civil claim filed by a former senior manager.

Director of human resources John Van Horne confirmed they reached an out-of-court settlement with Brian Denbigh, who claimed he was wrongfully terminated from his temporary role as manager of sanitation.

Van Horne couldn’t discuss details of the settlement.

Denbigh filed his civil action against the City in early 2017, claiming they breached a contract allowing him to fill a maternity leave position and then retire at the end of the five-month assignment.

Information filed by the City confirmed they cancelled his contract without cause roughly one month after he started his new role. They claimed the contract could be cancelled at any time with enough notice given.

“[The City] denies that the Plaintiff has suffered any loss or damage, as alleged or at all,” the City’s counter-claim said.

Despite the legal confidence, they settled out of court.

No specific dollar amount was listed by Denbigh in his request for punitive damages.
