DENVER, CO — Four of six charges against a former Port Alberni man accused in a brutal sexual assault in Colorado last fall have been thrown out.

Denver District Attorney’s office spokeswoman Lynn Kimbrough states that a judge Monday afternoon found probable cause for only two of the charges against Colby Messer.

Kimbrough states all of the charges were sexual assault, just charged under different theories and elements.

The 30-year-old Messer, who now lives in Victoria, is charged in relation to an alleged group assault on a 27-year-old woman in a Denver hotel room last November.
